WECREATE TERMS & CONDITIONS

These Terms of Service (this “Agreement”) is a contract between you (“you”) and WeCreate (“WeCreate”, “we” or “us”). You must read, agree with and accept all the terms and conditions contained in this Agreement to use our website www.wecreate.club (the “Site”) and related software and services (collectively, the “WeCreate services”). We may modify this Agreement at any time. Your continued use of WeCreate services after the effective date of a revised version of this Agreement constitutes your acceptance of its terms. This Agreement incorporates our terms of business, products and services on the attached Terms and Conditions which you confirm you have read and understood. Both parties agree to comply with these terms and our obligations as set out herein. This agreement is binding from the date of registration.

MEMBERSHIP

At WeCreate our users are required to fill in their personal information to become registered WeCreate members. Members get access to our Market Place. You can purchase any of our products – WorkPad, Meeting Space or Studio, which allows you to use our services at WeCreate that includes complimentary water, Organic beverages, Wi-Fi and add on services include - events, printing, food & beverages, WI-FI packages, lockers and much more at additional costs.

Product Definition

WORKPAD: A daily WorkPad provides access to a designated work area in a shared common room, working side-by-side with other WeCreate members. Includes Complimentary organic beverages & Wi-Fi.

STUDIO: A private office work space designated as per seating capacity. Studios can be booked with unfurnished and furnished options. Studios include complimentary organic beverages & Wi-Fi. Our infrastructure supports dedicated independent internet connections if you wish.

MEETING SPACE: WeCreate Meeting Space is our conference room, training room and party spaces. The Meeting Spaces are provided with complimentary water, organic beverages, Wi-Fi and basic stationary. Projectors can be arranged upon request.

CREDITS: At WeCreate we like to make everything easy and cashless for our members. We have streamlined payments, invoices and a billing system to be completely online and seamless. Once Credits are purchased online, members can use the credit for instant purchases of any services.
ONE CREDIT = Rs 1.

LOCKER: At WeCreate members have an option for storing their personal items in our locker room. Lockers can be booked online.

WI-FI: WeCreate offers complimentary Wi-Fi to all its members and guests. Additional packages for faster bandwidth are available online.

PRINTING: WeCreate members can purchase a printing package online.

EVENTS: WeCreate organises and host events to engage, educate and enhance our membership community. Frequent events will be held at WeCreate inviting resources, dignitaries that will help our community flourish in the competitive world.

FOOD & BEVERAGE: We believe a healthy body leads to a healthy mind. WeCreate provides complimentary organic beverages to all our members and visiting member guests. Additional goodies can be purchased from our WeCreate pantry.

PARKING: Parking space for 2 & 4 wheelers are available at a cost. The member can get in touch with their property manager.

GUEST: Members can invite guests to WeCreate through our online registration process.

Courier: WeCreate offices can be used as correspondence address for the members, who can receive and send mail under their company name.

TERMS & CONDITIONS

WORKPAD:

  • A WorkPad can be booked only through credits online.
  • Credits or credit packages can be purchased online.
  • No fixed seating is provided for WorkPad members
  • Minimum booking for a WorkPad is 1 day, maximum booking is 1 month.
  • Credits will only be refunded if booking of WorkPad is cancelled 48 hours in advance from the booking date.
  • WorkPad timings at WeCreate - 7:00 AM -7:00 PM Monday – Friday. We are closed on the weekends and public holidays.
  • Members can invite visitors to WeCreate property with our online registration process with an additional charge. Filling in the details of the guest is necessary. We provide your guests with complimentary organic beverages and Wi-Fi.
  • Members can invite maximum 2 visitors to the WeCreate property. Visitor bookings can be made from 9:00 am to 6:00 pm for a maximum of 3 hours at our property. Members can reserve a meeting space if they have more than 2 visitors.
  • Guest access cards will be handed over by the property manager to guests once they arrive. The access cards must be returned to the property manager while leaving the property.
  • If a guest access card is not returned on the same day, the member will pay an additional charge for the card.
  • WeCreate is not responsible for any personal belongings left behind or unattended.
  • No eatables allowed at your WorkPad station. WeCreate has designated area for snacks/meals for our members. Seating is as per availability.

STUDIO:

  • A Studio can be booked online through our simple online payment gateway.
  • WeCreate studio is a private office work space designated as per seating capacity.
  • The member can choose an unfurnished or furnished studio option. Furnished Studio will be at an additional cost. Those members who wish to bring in additional/alternate furniture would require to get in touch with their property manager for further approval.
  • Studio timings at WeCreate from 7:00 am to 12:00 midnight from Monday to Friday. Saturday from 9:00 am to 6:00 pm, we are closed on Sundays and public holidays.
  • On Saturdays, studios can be accessed but there is no air conditioning provided by the building association.
  • A studio can be booked for a minimum of 1 month and maximum of 12 months. But all bookings end on month end.
  • A studio can be booked from any date with a minimum lock in period of 1 month.
  • If a member wishes to use WeCreate products or any other additional services, the member would have to book the same online only through credits.
  • Each Studio will have a Studio Master. The master is required to add their team members after booking a Studio from his/her account.
  • The added members will receive a mail on the given email id with a link to sign in to WeCreate.
  • The added members once signed in will have access to reserve and purchase additional products & services online.
  • Only the Studio master has the rights to edit any information with regards to his/her studio.
  • The Studio master is given a key at request for their specific studio.
  • If a member loses a key, a replacement key can be collected from the property manager at an additional cost.
  • If members would like their studio to be cleaned on all or specific days, the Studio must be kept open post working hours.
  • No eatables are allowed in your Studio. WeCreate has a designated area for snacks/meals for our members. Seating is as per availability.
  • Members cannot transfer to a different Studio. If a Studio Master wishes to move to a different Studio, the Studio master must serve his notice period and make a new Studio booking as per his/her preference.
  • If a Studio Master books a studio post the 5th of a month, the minimum booking will be made for the pending days of that month and following month along with a one month deposit.
  • The Studio Master will receive an invoice for payment 8 days before month end. Last payment must be paid by the 3rd last day of the month to continue to enjoy the services.
  • Deposit amount is equivalent to one month's Studio rental.
  • If the studio master has not renewed their subscription by the last day of the month, the subscription will be de-activated. The members will not be able to avail the Studio benefits.
  • Members will be requested to vacate the Studio on the last working day of the month.
  • Notice Period – The Studio Master would require to send a notice 1 month prior to vacating the Studio. For example, if the Studio has been booked for 6 months but the member would like to vacate by the end of 4th month. The studio master would require to send a notice by the end of the 3rd month.
  • A studio booking cannot be cancelled, a one month notice must be served to terminate studio package.
  • If a studio member has not served a one month notice, deposit money will be forfeited.
  • If the members Studio package is expiring and the members do not want to renew their package the studio master would require to send the property manager a notice 1 month prior to the vacating date.
  • In case of any repair or maintenance, members will be requested to use a WorkPad or Studio as per availability till the issue is resolved.
  • If the studio has any pending payments for additional facilities used after vacating the Studio, the studio master will receive a mail with the details and cost. The total amount will be deducted from the member’s deposit.
  • If the studio has been damaged the studio master will receive a mail with the details and cost. The total amount will be deducted from the member’s deposit if the member is vacating else the member will be asked to pay through our online gateway.
  • Deposit - Account details of the studio master must be emailed during the notice period for the deposit money to be returned.
  • Deposit money will be refunded 45 days from vacating the studio.
  • The members may use WeCreate address as its correspondence business address. However, the members are not permitted to use the address of the designated property as their registered office address.
  • Parking: Studio members have an additional benefit to book car parking space online or through their property manager.
  • Car parking will be charged monthly and if the member vacates the Studio the parking space will be discontinued.
  • If a member requires a phone line, the member can get in touch with their property manager for further details and process. Payment will be made directly to the vendor.
  • Studio members can invite their visitors with our online registration process. Studio members’ visitors are allowed at WeCreate without charge for the 1st hour, for additional hours’ members, will be required to pay an additional cost. Filling in the details of the guest is necessary. Complimentary organic beverages and Wi-Fi is provided to member’s guests.
  • Members can invite maximum 2 visitors to the WeCreate property. Visitor bookings can be made from 9:00 am to 6:00 pm for a maximum of 3 hours at our property. Members can reserve a meeting space if they have more than 2 visitors.

  • If access card is not returned on the same day, the member will pay an additional charge for the card.

MEETING SPACE:

  • A Meeting Space can be booked online
  • Credits or credit packages can be purchased online.
  • Meeting Spaces are provided with Wi-Fi, organic beverages and stationary.
  • The minimum booking time for a Meeting Space is 1 hour and maximum is 12 hours.
  • WeCreate property has 2 Meeting Spaces - boardroom style and classroom style seating.
  • Meeting Space booking must be cancelled 48 hours prior to the booking date, for reimbursement of credits.
  • Credits will only be refunded if cancellation of Meeting Space is done 48 hours in advance from the booking time.
  • Meeting Space timings at WeCreate - 8:00 am to 8:00 pm Monday – Friday. We are closed on weekends and public holidays.
  • Meeting Space member can add visitors as per the seating capacity. Details of the visitor need to be added post booking in order to give Wi-Fi access to the visitors.
  • Access cards will be handed over by the property manager to the visitors once they arrive. The access cards must be returned to the property manager while leaving the property.
  • If access card is not returned on the same day, the member will pay an additional cost for the card.
  • WeCreate is not responsible for any personal belongings left behind or unattended

CREDITS:

  • All payments at WeCreate are made through credits
  • Payments towards booking a Studio, locker and purchasing credits are made through our simple online payment gateway.
  • ONE Credit = Rs 1 at WeCreate.
  • Free credits - These credits are add-on credits a member receives on purchasing a credit package or credits that a member receives as a part of an offer or discounts.
    • Free credits are consumed before paid credits.
    • Free credits can be consumed for advance booking for the following month.
    • Free credits expire every month end.
  • Paid Credits – these are purchased credits that have a validity till consumed.
  • As per the credit package chosen by the member, they receive a specific amount of credits in their account.
  • Additional Credits can be purchased at any time
  • If the member has insufficient or negative credits the member can log into their account online and follow the process of purchasing credits / credit package to regularise their dues.
  • Credits will only be refunded if a cancellation of a booking for a WorkPad, Meeting Space or Event is done 48 hours in advance.
  • Free Credits will be refunded if a cancellation is done 48 hours in advance in the same month only.
  • If any booking is made through free credits & cancelled in the same month of the booking, the credits will be refunded back. However, if an advance booking is made through free credits in September, for October & cancelled in October, as these are free credits, they cannot be refunded back as they expire that particular month.
  • Paid credits are always refunded back if bookings are cancelled 48 hours in advance.
  • No credit can be refunded or transferred once purchased.

REFUND POLICY:

  • WeCreate accepts payments only towards security deposit, purchase of products & credits.
  • Once a product or credits are purchased through our payment gateway, they are non-refundable. If due to any technical errors an amount is wrongly charged, the corrections will be done through net banking or payment gateway platform.
  • Security deposit refunds will take place through net banking only.

LOCKER:

  • At WeCreate members have an option for storing their personal items in our locker room.
  • Lockers can be purchased at an additional cost per month. A one month deposit will be charged on purchasing the locker.
  • Locker bookings cannot be cancelled or transferred.
  • We have limited lockers at WeCreate which can be booked from a period of minimum 1 month to maximum period of 3 months.
  • Member will receive the key from our property manager as per the allotted locker number.
  • If a member loses a key, a replacement key can be collected from the property manager at an additional cost.
  • If the member has damaged the locker the deposit shall not be refunded and deposit money will be charged to repair the locker.
  • If the member has not paid for his locker, the member will be requested to vacate their locker on the last working day of the month
  • If the member has not vacated their locker till the last working day of the following month, their deposit will be forfeited.
  • Locker deposit will be refunded 45 days from vacating the locker.

WI-FI:

  • Wi-Fi is complimentary at WeCreate. A password will be sent to the member daily through email / sms to access the internet.
  • If a member requires an advance internet package with a higher speed, the member can upgrade the package online through credits.
  • Members and visitors are requested to login to the Wi-Fi page with their credentials that will be sent to the members through email /sms.

PRINTING:

  • WeCreate members can purchase our printing packages online.
  • Members will receive a code once printing package is purchased that gives them access to using our Wi-Fi printer.

EVENTS:

  • WeCreate organises and host events to engage, educate and enhance our membership community. Monthly events will be held at WeCreate inviting resources and dignitaries that will help our community flourish in the competitive world.
  • At WeCreate events can be ticketed events and can be sold at an additional cost online.
  • Cancellation of tickets can be made online. Credits will only be refunded if cancellation of event tickets is done 48 hours in advance.
  • Members events / promotions can be promoted on our market place online.
  • Members can block WeCreate as a venue to host events.
  • Ticketed events by members cannot be sold on WeCreate website or app but can be promoted through the Market Place.

FOOD & BEVERAGE:

  • If a member wants to buy F&B items from our WeCreate pantry, the member will require to note down his choice of items on the list present in the pantry.
  • The property manager will send a mail at the end of the week or on the last working day of the month to the member with details of the items consumed with their prices.
  • The total credits will be deducted from the members account.

PARKING:

  • If a Workpad / Studio or Meeting Space member requires parking, they can get in touch with their property manager.
  • The member directly pays the building management for a parking space through the help of our property manager.
  • The payment will be monthly as per the booking date until cancelled.
  • If the parking space is not paid for the following month parking will be discontinued.

TOURS:

  • Tours are scheduled in advance for our visitors. You can book a tour on www.wecreate.club to schedule a tour!
  • Tour user can avail a trial day post visiting WeCreate property.

MAIL/ COURIER:

  • All mails and couriers will be placed in the locker room for members to collect or dispatch.
  • No large packages will be allowed into WeCreate property for storage, the maximum size package allowed into WeCreate property is 2ft x 2ft.
  • To send courier members must note down details of the courier in the register placed in the locker room. Additional charges apply to send couriers.
  • The property manager will send a mail at the end of the week & last working day of the month to the member with details and credits deducted.

ENTRANCE TO WECREATE PROPERTY:

  • WeCreate property has a biometric system for our Studio, WorkPad and Meeting Space members. First time members are requested to carry their id proof to the property for biometric process.
  • As per their booking at WeCreate, the member would be allowed to enter the property.
  • Access cards are given to registered visitors at point of entry by our property manager.
  • Access cards are property of wecreate & need to be returned on the same day. If not returned, additional charges apply.

WECREATE PRICING:

  • Pricing at WeCreate will be changed at a discretion of the management as per the financial year. Members will be notified through email with regards to revision of prices.

MEMBERS BELONGINGS:

  • WorkPad, Meeting Space and Studio members have the option of purchasing a locker to keep their belongings.
  • WeCreate shall not be responsible for any items left unattended at the property.

PETS AT WECREATE:

  • WeCreate does not allow pets at our property

SMOKING AT WECREATE:

  • WeCreate is a non-smoking property

UNSUBSCRIBE WECREATE:

  • Those Members who have not been active online for 6 months will be deactivated automatically.
  • To reactivate yourself as a member, the member must register again to access WeCreate services.

SECURITY AT WECREATE:

  • Our WeCreate property is under surveillance 24x7, we have CCTV cameras placed at designated areas within our property. We also have a biometric system that only allows our members to access the property. The property has Fire extinguishers within the property.

WECREATE OFFICE TIMINGS:

WorkPad:                 7:00 am - 7:00 pm Monday to Friday. We are closed on the weekend.
Meeting Space:      8:00 am - 8:00 pm Monday to Friday. Saturday from 9:00 am to 6:00 pm.
Studio:                     7:00 am – 12:00 am Monday to Friday. Saturday, we are open from 9:00 am to 6:00 pm We are closed on Sundays and public holidays.

Agreement automatic renewal: this agreement lasts for a period of 1 year and will be automatically renewed at year end, unless terminated by the member or by WeCreate. All periods shall run to the last day of the month in which they would otherwise expire.

Ending this Agreement immediately: WeCreate may put an end to this Agreement immediately by giving the member due notice and without need to follow any additional procedure if:

(a) the member becomes insolvent, bankrupt, goes into liquidation or becomes unable to pay his debts as they fall due, or

(b) the member is in breach of one of his obligations which cannot be put right, or

(c) his conduct &/or behaviour with someone at WeCreate and is incompatible with commonly understood business use, which shall be determined at WeCreate’s sole discretion and (i) such conduct is repeated despite the member having been given a warning or (ii) such conduct is material enough (in WeCreate’s opinion) to permit immediate termination.

If WeCreate puts an end to this Agreement for any of these reasons, it does not end any outstanding obligations, including the payment of any additional services used, requested or required under the agreement as well as the monthly fee for the remainder of the period for which this Agreement would have lasted had WeCreate not ended it.

If WeCreate property is no longer available: In the event that WeCreate is no longer able to provide the services at the designated property stated in this Agreement, then this agreement will end and the Member will only have to pay up to the date it ends and for the additional services the Member has used. WeCreate will try to find suitable alternatives for the Member at another WeCreate Property.

Notices: All formal notices must be in writing, which may include email, to the registered email ID on the website and app.

Confidentiality: The terms of this Agreement are confidential. Neither WeCreate nor the member may disclose them without the other’s consent unless required to do so by law or an official authority. This obligation continues for a period of 3 years after this Agreement ends.

Applicable law: This agreement is interpreted and enforced in accordance with the law of the place where WeCreate is located. All dispute resolution proceedings will be conducted in the country/state or province where WeCreate is located. Should any provision of these terms and conditions be held void or unenforceable under the applicable law, the other provisions shall remain in force.

Compliance with the law: The Member must comply with all relevant laws and regulations in the conduct of his business. The Member must do nothing illegal in connection with his use of WeCreate Property. The Member must not do anything that may interfere with the use of the Property by WeCreate or by others, cause any nuisance or annoyance, increase the insurance premiums WeCreate must pay, or cause loss or damage to WeCreate (including damage to reputation) or to the owners of the building which contains the Property the Member is using. Both the Member and WeCreate shall comply at all times with all relevant anti-bribery and anti-corruption laws.

Use of the Property Address: The Member may use the designated WeCreate address as his correspondence business address but not as his legal registered office. It is the member's responsibility to remove their address once they vacate the property.

Should WeCreate be advised by any government authority or other legislative body that it has reasonable suspicion that any Member is conducting criminal &/or illegal activities from the Property, then WeCreate shall be entitled to terminate this agreement with immediate effect.

The Member acknowledges that (a) the terms of this clause are a material inducement in WeCreate’s execution of this agreement and (b) any violation by the Member of this clause shall constitute a material default by the Member hereunder, entitling WeCreate to terminate this agreement, without further notice or procedure.

The Member acknowledges and accepts that its personal data may be transferred or made accessible to all entities of WeCreate group, wherever located, for the purposes of providing the services herein.

The Member must not carry on a business that competes with WeCreate’s business of providing serviced office accommodations or any ancillary services.

o the maximum extent permitted by applicable law, WeCreate will not be liable for any loss sustained as a result of WeCreate’s failure to provide a service as a result of any mechanical breakdown, strike, or termination of WeCreate’s interest in the building containing the Property. The member expressly and specifically agrees to waive, and agrees not to make, any claim for damages, direct, indirect, punitive, special or consequential, including, but not limited to, loss of business, revenue, profits or data, for any reason whatsoever arising out of, or in connection with this agreement. Any failure to furnish any service provided, any error or omission with respect thereto, or any interruption of services.

Taxes And Duty Charges: The Member agrees to pay promptly (i) all service, sales, use, excise, GST and any other taxes and license fees which the Member is required to pay to any governmental authority (and, at WeCreate’s request, will provide WeCreate evidence of such payment) and (ii) any taxes paid by WeCreate to any governmental authority that are attributable to office space rentals, where applicable, including, without limitation, any gross receipts, occupancy taxes, tangible personal property taxes, stamp duty or other documentary taxes and fees.

Payments: WeCreate is continually striving to reduce its environmental impact and supports its Members in doing the same. Therefore, WeCreate will send all invoices electronically (where allowed by law) and the Member will make payments via an automated method such as Direct Debit, Credit Card, Net Banking, Cash Card, Mobile Payments, Wallet and UPI through our payment gateway

Discounts, Promotions and Offers: If the Member has benefited from a special discount, promotion or offer, WeCreate may discontinue that discount, promotion or offer without notice if the Member materially breaches these terms and conditions.

Force Majeure: WeCreate shall have no liability to the member under this Agreement if it is prevented from, or delayed in, performing its obligations under this Agreement or from carrying on its business by acts, events, omissions or accidents beyond its reasonable control, including (without limitation) strikes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, disease or quarantine restrictions in compliance with any law or governmental order, rule, regulation or direction, accident, fire, flood, storm or default of suppliers or subcontractors. WeCreate’s obligations to perform shall be suspended during the period required to overcome such force majeure event. WeCreate shall notify the member as soon as reasonably possible of the force majeure event and propose a suitable alternative accommodation (if any) in the same WeCreate property or in another available WeCreate property.
